\r\n\r\n\r\n This California Consumer Notice at Collection and Privacy Policy (“Policy”\r\n or “Notice”) supplements and is expressly made part of the information\r\n contained in the Privacy Policy of GOLD STAR MORTGAGE FINANCIAL GROUP,\r\n CORPORATION (collectively, “Gold Star”, “We,” “Us,” or “Our”) and applies\r\n solely to consumers, visitors, users, and others who reside in the State\r\n of California (“Consumers”, “You” or “Your”). We adopt this Policy to\r\n comply with the California Consumer Privacy Act of 2018 and, as amended,\r\n the California Privacy Rights Act of 2020 (together, “CPRA”), and other\r\n California privacy laws. Any terms defined in the CPRA or its implementing\r\n regulations have the same meaning when used in this Policy.\r\n

\r\n The purpose of this Policy is to comply with California law and provide\r\n You with a comprehensive description of Our online and offline practices\r\n regarding collection, use, and disclosure of personal information (“PI”)\r\n (as defined in the CPRA) and of Your rights regarding Your personal\r\n information.\r\n

| D. Commercial information. | \r\n\r\n Records of personal property, products or services purchased,\r\n obtained, or considered, or other purchasing or consuming\r\n histories or tendencies.\r\n | \r\n
| E. Biometric information. | \r\nVoice recordings as part of call recordings. | \r\n
| F. Internet or other similar network activity. | \r\n\r\n Browsing history, search history, information on a consumer's\r\n interaction with a website, application, or advertisement.\r\n | \r\n

| H. Sensory data. | \r\n\r\n Audio, electronic, or similar information, as part of any voice\r\n call recordings.\r\n | \r\n
| I. Professional or employment-related information. | \r\nCurrent or past job history or performance evaluations. | \r\n
| \r\n J. Non-public education information (per the Family Educational\r\n Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part\r\n 99)).\r\n | \r\n\r\n Educational records directly related to a student that are\r\n maintained by an educational institution such as years in school\r\n or student loans obtained.\r\n | \r\n
| K. Inferences drawn from other personal information. | \r\n\r\n Derivation of information, data, assumptions, conclusions, from\r\n facts, evidence or another source of data drawn from any of the\r\n information identified above to create a profile about a\r\n Consumer reflecting the Consumer’s preferences, characteristics,\r\n or tendencies with respect to obtaining a mortgage loan.\r\n | \r\n

\r\n\r\n Use of Personal Information \r\n
\r\n\r\n We or our service providers use Your personal information for Our\r\n operational purposes, or other notified purposes, which uses We strive\r\n to ensure are reasonably necessary and proportionate to achieve Our\r\n operational purposes for which We collect Your information in the first\r\n place, or for which We process Your information, or for another\r\n operational purpose that is compatible with the context in which We\r\n collect Your personal information. For example, the following are\r\n business purposes for which We collect or share Your information:\r\n

\r\n\r\n Sharing Personal Information \r\n
\r\n\r\n All financial companies need to disclose personal information to run\r\n their everyday business and provide the services You hope to obtain. We\r\n may disclose Your personal information to a third party for a business\r\n purpose. When We disclose personal information for a business purpose,\r\n We typically enter into a contract that describes the purpose and\r\n requires the recipient to both keep that personal information\r\n confidential and not use it for any purpose except performing the\r\n contract.\r\n
\r\n\r\n\r\n In the preceding twelve (12) months, We have disclosed the above\r\n categories of personal information for a business purpose to the\r\n following categories of third parties:\r\n
\r\n\r\n We will comply with other federal and state laws and regulations that\r\n impact Our disclosure practices.\r\n
\r\n\r\n\r\n Sales of Personal Information \r\n
\r\n\r\n\r\n Gold Star does not sell consumer information nor have We sold personal\r\n information in the preceding 12 months outside of the permitted sharing,\r\n disclosures, or transfers made pursuant to the exemptions of the\r\n Gramm-Leach-Bliley Act or the Fair Credit Reporting Act. We have no\r\n actual knowledge of selling or sharing personal information of anyone\r\n under the age of 16 years old. Notwithstanding the foregoing, We will\r\n accept a verified request from You to not sell or share Your personal\r\n information should Our practices change in the future.\r\n
\r\n\r\n\r\n \r\n Retention of Your Personal Information\r\n \r\n
\r\n\r\n\r\n We retain Your personal information throughout Our business relationship\r\n with You and thereafter only for as long as required to fulfil the\r\n purposes for which it was collected. However, in some circumstances We\r\n may retain personal information for longer periods of time, for instance\r\n when We are required to do so in accordance with legal and regulatory\r\n requirements or to resolve disputes that may arise between You and Us.\r\n
\r\n\r\n Your Rights and Choices \r\n
\r\n\r\n The CPRA provides Consumers (California residents) with specific rights\r\n regarding their personal information. This section describes Your CPRA\r\n rights and explains how to exercise those rights.\r\n
\r\n\r\n When You make a request, We may require that You provide information and\r\n follow procedures so that We can verify the request and Your\r\n jurisdiction before responding to it. The verification steps We take may\r\n differ depending on the request You make. We will match the information\r\n that You provide in Your request to information We already have on file\r\n to verify Your identity. If We can verify Your request, We will process\r\n it. If We cannot verify Your request, We may ask You for additional\r\n information to help Us verify Your request.\r\n
\r\n\r\n\r\n Consumers will be required to submit their first and last name and email\r\n address and may also be asked to provide their telephone number or\r\n address so that We can verify the request. Please provide as much of the\r\n requested information as possible to help Us verify the request. We will\r\n only use the information received in a request for the purposes of\r\n responding to the request.\r\n
\r\n\r\n\r\n California law permits California Consumers to use an authorized agent\r\n to make privacy rights requests. We require the authorized agent to\r\n provide Us with proof of the California Consumer’s written permission\r\n (for example, a power of attorney) that shows the authorized agent has\r\n the authority to submit a request for the California Consumer. An\r\n authorized agent must follow the process described below to make a\r\n request. The authorized agent must also verify his/her own identity. We\r\n will confirm the agent’s authority with the California Consumer about\r\n whom the request was made.\r\n
\r\n\r\n\r\n The right to request deletion is not absolute and is subject to several\r\n restrictions and exemptions. Gold Star reserves all rights granted\r\n pursuant to the CPRA’s exemptions and restrictions relating to the\r\n deletion of personal information.\r\n
\r\n\r\n\r\n We may deny Your deletion request if We cannot verify Your identity, if\r\n We cannot verify the authorization of Your agent, if the information was\r\n not collected from You, or is otherwise not subject to the rights\r\n granted by the CPRA, or if retaining the information is necessary for Us\r\n or Our service providers to:\r\n
\r\n\r\n\r\n In the event that We receive a “Verified Request” to delete information\r\n that is not covered by a restriction or exemption, We will notify You\r\n within 45 days and delete Your personal information from our records,\r\n and direct any service providers to delete Your personal information\r\n from its records. In the event that We receive a “Verified Request” to\r\n delete information that is covered by a restriction or exemption, We\r\n will deny Your request and within 45 days provide You a response\r\n indicating why it is denied.\r\n
\r\n\r\nYou may submit a verified request to Us by:
\r\n\r\n Note: Gold Star does not “sell” or “share” (as\r\n defined in the CPRA) Consumer information. Additionally, Gold Star does\r\n not use or disclose sensitive personal information for purposes other\r\n than those specified in section 7027, subsection (m) of the CPRA.\r\n

\r\n\r\n We do not knowingly collect, process, use, sell, or share personal\r\n information of those 16 years old or younger.\r\n
